Massachusetts gives homeowners more protection on a remodeling contract than most states, and almost nobody knows what it covers. The rules live in Chapter 142A of the General Laws, they apply to work on one-to-four family homes over $1,000, and one of them can cost you everything you were protected for β by accident, in a single decision most people think is helping.
The four rules worth knowing before you sign
- A written contract is required for any home improvement work over $1,000. Not recommended β required. It has to carry specific terms, notices and a payment schedule.
- The deposit is capped at one third of the contract price, or the actual cost of special-order materials, whichever is greater. A contractor asking for half up front on a standard job is outside the rule.
- You have three business days to cancel after signing, and the contractor has to give you written notice of that right at signing. If they do not, your window to cancel extends.
- Registered contractors pay into a Guaranty Fund. If a registered contractor takes your money and disappears, or fails to satisfy a judgment, that fund exists as a route to recovery.
The trap: pull your own permit and you lose the Guaranty Fund
This is the part that matters most, and it is the least known. Under c.142A, a homeowner who obtains their own building permit is not eligible to access the Guaranty Fund. The contract is even required to say so.
Now think about how that plays out. A contractor says the permit will be faster or cheaper if you pull it yourself β sometimes framed as a favour, sometimes as saving a fee. You agree. In that moment you have not saved money; you have moved the liability onto yourself and forfeited the single strongest financial protection the Commonwealth gives you.
There is usually a reason behind the request. A contractor who cannot pull a permit in their own name may not be registered, may not carry the insurance the town requires, or may have a history the building department knows about. The request is the signal.

HIC registration and a Construction Supervisor Licence are not the same thing
These get used interchangeably and they are different credentials with different purposes.
- Home Improvement Contractor registration is a consumer-protection registration. It is what makes a contractor subject to c.142A and what funds the Guaranty Fund. Waterfront Construction is HIC #196540.
- A Construction Supervisor Licence is a building-code competency licence, and it is what allows someone to pull permits for structural work.
- A contractor can hold one without the other. Ask for both numbers, and check them rather than taking a business card at face value.
- Also ask for a certificate of insurance sent directly from the insurer, not a photocopy. Liability and workers' compensation both matter β an uninsured worker injured on your property is your exposure.
What a compliant contract should actually contain
- Total price and a payment schedule tied to milestones, not to dates. Payment on completion of a stage is verifiable; payment on the 15th is not.
- A start date and a completion date, both written.
- A detailed scope. Itemised, not a lump sum β a single number cannot be compared to any other quote.
- Who pulls the permit, named explicitly.
- A written change-order process: what happens when something is found behind a wall, and who authorises the extra cost before it is incurred.
- Warranty terms on labour, stated separately from any manufacturer warranty on materials.
- The contractor's HIC registration number and the required notices, including the cancellation right.
If it goes wrong
Stop paying ahead of work completed. The payment schedule is your leverage and it stops being leverage the moment you are paid up in advance.
Put everything in writing, including phone conversations β a short email summarising what was agreed is worth more later than a perfect memory.
Photograph the state of the work regularly with dates. It is tedious and it is the evidence that settles disputes.
The Office of Consumer Affairs and Business Regulation administers the registration programme and the Guaranty Fund, and there is an arbitration route for disputes with registered contractors. None of it is available for work done by an unregistered contractor β which is the real reason to check the number before signing rather than after.
