On 2 February 2025 Massachusetts became one of a handful of states to legalise accessory dwelling units by right. If you have wanted an in-law suite, a garage conversion or a small detached cottage on your lot, the rules changed substantially in your favour β and most homeowners still do not know it.
What actually changed
The Affordable Homes Act, signed in August 2024 and effective 2 February 2025, makes an accessory dwelling unit under 900 square feet a protected use in every single-family residential zoning district in the Commonwealth. The implementing regulation is 760 CMR 71.00.
Protected use means by right. Your town cannot require a special permit, a variance or any other discretionary zoning approval for a qualifying ADU. Zoning provisions that conflict with the law became unenforceable on that date.
What your town may no longer do
- Require a special permit, variance or discretionary zoning approval for a qualifying ADU.
- Impose an owner-occupancy requirement β you do not have to live on the property.
- Require more than one additional parking space. If the property is within half a mile of a transit station, no additional parking may be required at all.
- Apply dimensional rules to the ADU that are stricter than those applied to the primary dwelling in the same district.
What your town may still require
By right is not the same as unregulated. The building permit process still applies in full, and so does everything that is not zoning.
- A building permit, plus the electrical, plumbing and gas permits the work triggers.
- Full compliance with the Massachusetts building code, including egress, ceiling height, fire separation and insulation.
- Title 5 septic compliance if you are not on sewer β and this is the item most likely to change your budget. An additional dwelling unit adds design flow, and your existing system may not have capacity.
- Reasonable local regulation on matters outside the prohibited list, subject to a reasonableness test in the regulation.
Septic is the real gatekeeper outside the sewer districts
In much of MetroWest and Worcester County, whether an ADU is straightforward comes down to the septic system. Massachusetts guidance is that a town may require a Title 5 upgrade, but a blanket demand for an entirely separate new system has to serve a legitimate municipal interest and cannot impose excessive cost without advancing it β particularly where the existing system already has capacity or could be upgraded more cheaply.
The practical order of operations: find out your system's permitted design flow before you draw anything, and read how long the whole process takes. It is the cheapest question you will ask on the whole project, and it decides whether you are planning a two-bedroom ADU or a one-bedroom.

How to start without wasting money
Three questions, in this order, before you spend anything on design:
- Is your lot in a single-family residential district? That is what triggers the protected use.
- Are you on sewer or septic? If septic, what is the permitted design flow of the existing system?
- Which form makes sense for your property β conversion of existing space is almost always cheaper than new construction.
The cheapest square foot of an ADU is the one that already has a roof over it. Look at the basement, garage and attic before you look at the back yard.
